Substance Use Records and Additional Protections
Records from most federally assisted substance use treatment programs have extra protection under 42 CFR Part 2. In general they cannot be shared with family, employers, or law enforcement without your written consent, except in limited cases such as a medical emergency or a qualifying court order.
Other health records follow HIPAA and state law, which allow certain disclosures without consent, such as reports of suspected child abuse or to prevent a serious and imminent threat.
